Code of Conduct

This Code of Conduct governs the behavior of all Clients, defined as individuals or entities, including their employees, staff, partners, or authorized representatives (collectively, "Users"), who subscribe to or use the services, software, and platforms provided by GFunnel Business LLC ("GFunnel," "we," "us," or "our"), including but not limited to the GFunnel Platform, Branded Flows AI software, GFunnel Email, SMS GFunnel, CRM, Websites, and other marketing and business tools (collectively, "Services"). This Code applies to all Users, including Independent Business Contractors (IBCs) acting as clients, affiliates, or members, using the Services to manage business operations or serve third parties. By accessing or using the Services, you agree to comply with this Code and ensure that your Users comply. Violation of this Code may result in suspension or termination of access to the Services, at GFunnel’s sole discretion.
1. Purpose
The purpose of this Code of Conduct is to foster a professional, lawful, and ethical environment for all Users of GFunnel’s Services. It complements the Terms of Service (https://www.gfunnel.com/terms), Privacy Policy (https://www.gfunnel.com/privacy), Acceptable Use Policy (https://www.gfunnel.com/acceptable-use-policy), AI Acceptable Use Policy (https://www.gfunnel.com/ai-acceptable-use-policy), and, where applicable, Business Associate Agreement (https://www.gfunnel.com/baa). This Code ensures compliance with applicable laws, protects GFunnel’s reputation, and promotes a positive experience for all stakeholders.
2. Expected Behaviors
You and your Users are expected to engage with the Services in a manner that is professional, respectful, and compliant with all applicable laws and GFunnel’s policies. Expected behaviors include:
- Lawful Conduct: Using the Services in compliance with all national, state, and local laws, including data protection laws (e.g., GDPR, CCPA), anti-spam laws (e.g., CAN-SPAM, TCPA), and intellectual property laws.
- Ethical Use: Conducting business operations and serving third parties (e.g., your customers) with honesty, integrity, and transparency, including disclosing when content is AI-generated via the Branded Flows AI software.
- Respectful Interaction: Communicating with other Users, GFunnel staff, and third parties in a courteous and non-discriminatory manner, free from harassment, abuse, or intimidation.
- Secure Practices: Maintaining the confidentiality of access credentials and ensuring secure use of the Services to prevent unauthorized access or data breaches.
- Compliance with Policies: Adhering to all GFunnel policies, including the Anti-Spam Policy (https://www.gfunnel.com/antispam) and, where applicable, the Business Associate Agreement for handling Protected Health Information (PHI).
3. Prohibited Behaviors
You and your Users are strictly prohibited from engaging in behaviors that violate this Code, applicable laws, or GFunnel’s policies. Prohibited behaviors include, but are not limited to:
- Unlawful Activities: Engaging in or facilitating illegal activities, such as fraud, identity theft, or distribution of unlawful content (e.g., pirated software, child exploitation material).
- Harassment or Discrimination: Harassing, intimidating, or discriminating against individuals or groups based on race, ethnicity, gender, sexual orientation, religion, disability, age, or any other protected characteristic.
- Abusive Conduct: Posting or transmitting content that is defamatory, threatening, abusive, or obscene, or that violates third-party rights, including intellectual property or privacy rights.
- Spamming: Sending unsolicited or unauthorized communications, including junk mail, chain letters, or spam, in violation of the Anti-Spam Policy.
- Misrepresentation: Impersonating GFunnel, its employees, or other Users, or misrepresenting your affiliation with GFunnel or third parties.
- Security Violations: Attempting to gain unauthorized access to the Services, introducing malicious code, or engaging in activities that disrupt platform functionality (e.g., denial-of-service attacks).
- Data Misuse: Storing or processing sensitive information (e.g., credit card data, Social Security numbers, PHI) in unauthorized areas of the Services, unless permitted under a signed Business Associate Agreement.
- Competitive Harm: Using the Services to develop competing products or services or to engage in competitive analysis detrimental to GFunnel’s interests.
- Slamming: Engaging in unauthorized switching of a customer’s service provider without consent.
- Unethical Practices: Engaging in deceptive, misleading, or unethical practices, such as generating fake reviews, astroturfing, or using AI-generated content to mislead third parties.
4. Client Responsibilities
As a Client, you are responsible for ensuring that your employees, staff, partners, and other authorized Users comply with this Code of Conduct. Your responsibilities include:
- Training and Monitoring: Training Users on ethical and lawful conduct when using the Services, including compliance with this Code, and monitoring their behavior to prevent violations, especially when serving third parties.
- Content Oversight: Reviewing all content posted or transmitted via the Services (e.g., websites, emails, SMS, AI-generated outputs) to ensure compliance with this Code and applicable laws.
- Legal Compliance: Ensuring Users obtain necessary consents and maintain accurate records for data processing (e.g., GDPR, TCPA) and comply with all applicable laws.
- Credential Security: Ensuring Users maintain the confidentiality of access credentials and report unauthorized use immediately to onestop@gfunnel.com.
- Liability: You are liable for any violations of this Code by your Users, including any damages, losses, or expenses incurred by GFunnel as a result, as specified in the Terms of Service (Section 16).
5. Enforcement
GFunnel reserves the right to investigate suspected violations of this Code of Conduct. If GFunnel determines, in its sole discretion, that you or your Users have violated this Code, GFunnel may:
- Suspend or terminate access to the Services for you or specific Users without notice.
- Remove or disable access to any content or materials that violate this Code.
- Report violations to appropriate authorities, including law enforcement or regulatory bodies.
- Pursue any other remedies available under the Terms of Service, including termination of the Agreement or collection of damages.
GFunnel has no obligation to prescreen or monitor User conduct but may do so to enforce this Code. You agree to cooperate with GFunnel in investigating or resolving any suspected violations.
6. Reporting Violations
If you become aware of any violation of this Code by you, your Users, or third parties, you must promptly notify GFunnel at onestop@gfunnel.com. Provide details of the violation, including the nature, date, and affected Services, to facilitate investigation.
7. Third-Party Services
The Services may integrate with third-party providers (e.g., Lead Connector, MyDukaan, Yext). You and your Users must comply with the terms of service and conduct requirements of these providers when using integrated services. GFunnel is not liable for violations of third-party terms or misconduct involving third-party services.
8. Updates to this Code of Conduct
GFunnel may update this Code of Conduct to reflect changes in the Services, laws, or business needs. Updates will be posted at https://www.gfunnel.com/code-of-conduct, with the "Last Updated" date revised. You will be notified of material changes via email or GFunnel platform notification. Continued use of the Services after updates constitutes acceptance of the revised Code. If you do not agree with changes, you must notify GFunnel in writing within 30 days at onestop@gfunnel.com, and the prior Code will apply until the end of your current Term.
