AI Acceptable Use Policy

This AI Acceptable Use Policy ("AI AUP") governs the use of the Branded Flows AI software ("AI Software") provided by GFunnel Business LLC ("GFunnel," "we," "us," or "our") as part of our services, software, and platforms (collectively, "Services"). This AI AUP applies to all Clients, defined as individuals or entities, including their employees, staff, partners, or authorized representatives (collectively, "Users"), who subscribe to or use the AI Software, including Independent Business Contractors (IBCs) acting as clients, affiliates, or members, to manage business operations or serve third parties. By accessing or using the AI Software, you agree to comply with this AI AUP and ensure that your Users comply. Violation of this AI AUP may result in suspension or termination of access to the AI Software or Services, at GFunnel’s sole discretion.

1. Purpose

The purpose of this AI AUP is to ensure that the Branded Flows AI software is used in a lawful, ethical, and secure manner, consistent with GFunnel’s Terms of Service (https://www.gfunnel.com/terms), Privacy Policy (https://www.gfunnel.com/privacy), Acceptable Use Policy (https://www.gfunnel.com/acceptable-use-policy), and applicable laws, including data protection (e.g., GDPR, CCPA), anti-spam (e.g., CAN-SPAM, TCPA), and intellectual property laws. This AI AUP protects the integrity of the AI Software, safeguards GFunnel’s reputation, and ensures compliance with ethical AI standards.

2. Permitted Uses

You and your Users may use the AI Software only for lawful and ethical purposes, as authorized by your Service Agreement, Service Order, or Online Order Form. Permitted uses include:

  • Creating and managing marketing content, such as emails, social media posts, or website copy, to support business operations or serve third parties (e.g., your customers).
  • Automating workflows, such as lead nurturing or customer engagement processes, within the GFunnel Platform.
  • Analyzing data to generate insights, reports, or recommendations for marketing or business strategies, provided outputs are reviewed for accuracy and compliance.
  • Using AI-generated content in compliance with all applicable laws and GFunnel’s policies, with clear disclosure to third parties that content is AI-generated.

3. Prohibited Uses

You and your Users are strictly prohibited from using the AI Software in any manner that violates this AI AUP, applicable laws, or GFunnel’s policies. Prohibited uses include, but are not limited to:

  • Unlawful Content: Generating or distributing content that is illegal, defamatory, discriminatory, harassing, violent, pornographic, or otherwise unlawful, including content that promotes hate speech, child exploitation, or abuse.
  • Misleading Content: Creating AI-generated content that misrepresents facts, impersonates individuals, or engages in disinformation campaigns, including astroturfing or generating fake reviews.
  • Automated Decision-Making: Using the AI Software for automated decision-making with legal or significant effects (e.g., credit eligibility, employment decisions, medical diagnoses) without human oversight.
  • Intellectual Property Violations: Generating content that infringes third-party copyrights, trademarks, or other intellectual property rights, or using the AI Software to plagiarize or engage in academic dishonesty.
  • Prohibited Industries: Using the AI Software to support activities in illegal or highly regulated industries, such as gambling, payday lending, cryptomining, weapons development, or unauthorized legal, medical, or financial advice.
  • Data Misuse: Processing sensitive information (e.g., credit card data, Social Security numbers, HIPAA-protected health information) through the AI Software, unless explicitly permitted with a signed Business Associate Agreement (BAA) for HIPAA data.
  • Security Violations: Using the AI Software to generate malicious code, engage in hacking, or overload GFunnel’s servers with excessive requests.
  • Spamming: Using AI-generated content for unsolicited advertising or spam, in violation of the GFunnel Anti-Spam Policy (https://www.gfunnel.com/antispam).
  • Competitive Use: Using the AI Software to develop competing products or services or for competitive analysis detrimental to GFunnel’s interests.
  • Unauthorized Sharing: Sharing AI-generated content, prompts, or outputs with unauthorized persons or entities not bound by GFunnel’s Terms, Privacy Policy, or this AI AUP.

4. Client Responsibilities

As a Client, you are responsible for ensuring that your employees, staff, partners, and other authorized Users comply with this AI AUP. Your responsibilities include:

  • Training and Monitoring: Training Users on the ethical and secure use of the AI Software and monitoring compliance to prevent misuse, especially when serving third parties.
  • Content Review: Reviewing all AI-generated content to ensure accuracy, legality, and compliance with this AI AUP before use or distribution.
  • Disclosure: Disclosing to third parties (e.g., your customers) when content or interactions are AI-generated, ensuring transparency.
  • Legal Compliance: Ensuring that Users comply with all applicable laws when using the AI Software, including obtaining necessary consents for data processing (e.g., GDPR, TCPA) and maintaining accurate records.
  • Credential Security: Ensuring that Users maintain the confidentiality of access credentials and report unauthorized use immediately to onestop@gfunnel.com.
  • Liability: You are liable for any violations of this AI AUP by your Users, including any damages, losses, or expenses incurred by GFunnel as a result.

5. AI Data Usage

GFunnel may use anonymized and aggregated data generated by the AI Software (e.g., usage patterns, workflow analytics) to improve the Services, including training and enhancing AI models, as permitted by our Privacy Policy (https://www.gfunnel.com/privacy). You grant GFunnel a non-exclusive, royalty-free license to use such data for these purposes, provided it does not identify you or your customers.

6. Enforcement

GFunnel reserves the right to monitor usage of the AI Software to ensure compliance with this AI AUP. If GFunnel determines, in its sole discretion, that you or your Users have violated this AI AUP, GFunnel may:

  • Suspend or terminate access to the AI Software or Services for you or specific Users without notice.
  • Remove or disable access to any AI-generated content or materials that violate this AI AUP.
  • Report violations to appropriate authorities, including law enforcement or regulatory bodies.
  • Pursue any other remedies available under the Terms of Service, including termination of the Agreement or collection of damages.

GFunnel has no obligation to prescreen, monitor, or edit AI-generated content but may do so to enforce this AI AUP. You agree to cooperate with GFunnel in investigating or resolving any suspected violations.

7. Reporting Violations

If you become aware of any violation of this AI AUP by you, your Users, or third parties, you must promptly notify GFunnel at onestop@gfunnel.com. Provide details of the violation, including the nature, date, and affected Services, to facilitate investigation.

8. Third-Party Services

The AI Software may integrate with third-party providers (e.g., Lead Connector, MyDukaan, Yext). You and your Users must comply with the terms of service, acceptable use policies, and other requirements of these providers when using integrated services with the AI Software. GFunnel is not liable for violations of third-party terms or disruptions in third-party services.

9. Updates to this AI AUP

GFunnel may update this AI AUP at its discretion to reflect changes in the AI Software, Services, laws, or business needs. Updates will be posted at https://www.gfunnel.com/ai-acceptable-use-policy, with the "Last Updated" date revised. You will be notified of material changes via email or GFunnel platform notification. Continued use of the AI Software or Services after updates constitutes acceptance of the revised AI AUP. If you do not agree with changes, you must notify GFunnel in writing within 30 days at onestop@gfunnel.com, and your subscription will continue under the prior AI AUP until the end of your current Term.
