Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs the use of services, software, and platforms provided by GFunnel Business LLC ("GFunnel," "we," "us," or "our"), including but not limited to the GFunnel Platform, Branded Flows AI software, GFunnel Email, SMS GFunnel, CRM, Websites, and other marketing and business tools (collectively, "Services"). This AUP applies to all Clients, defined as individuals or entities, including their employees, staff, partners, or authorized representatives (collectively, "Users"), who subscribe to or use the Services, including Independent Business Contractors (IBCs) acting as clients, affiliates, or members, to manage business operations or serve third parties. By accessing or using the Services, you agree to comply with this AUP and ensure that your Users comply. Violation of this AUP may result in suspension or termination of access to the Services, at GFunnel’s sole discretion.
1. Purpose
The purpose of this AUP is to ensure that the Services are used in a lawful, ethical, and secure manner, consistent with GFunnel’s Terms of Service (https://www.gfunnel.com/terms), Privacy Policy (https://www.gfunnel.com/privacy), and other referenced policies. This AUP protects the integrity, security, and reliability of the Services, safeguards GFunnel’s reputation, and ensures a positive experience for all users.
2. Permitted Uses
You and your Users may use the Services only for lawful purposes and in accordance with this AUP, the Terms of Service, and all applicable laws, including but not limited to data protection laws (e.g., GDPR, CCPA), anti-spam laws (e.g., CAN-SPAM, TCPA), and intellectual property laws. Permitted uses include:
- Managing business operations, such as customer relationship management, marketing campaigns, website hosting, and e-commerce, to serve third parties (e.g., your customers).
- Using the Branded Flows AI software to create and manage marketing content, automate workflows, and analyze data, in compliance with the AI Acceptable Use Policy (https://www.gfunnel.com/ai-acceptable-use-policy).
- Accessing GFunnel Platforms through authorized web browsers or mobile applications with secure, password-protected credentials.
- Engaging in activities explicitly authorized by your Service Agreement, Service Order, or Online Order Form.
3. Prohibited Uses
You and your Users are strictly prohibited from using the Services in any manner that violates this AUP, applicable laws, or GFunnel’s policies. Prohibited uses include, but are not limited to:
- Illegal Activities: Engaging in or facilitating unlawful activities, including distributing pirated software, copyrighted material, or links thereto; propagating computer worms, viruses, or malware; using false identities; or attempting unauthorized access to any network or system.
- Slamming: Engaging in unauthorized switching of a customer’s service provider without consent.
- Prohibited Content: Storing, transmitting, or linking to content that is pornographic, sexually explicit, violent, harassing, defamatory, discriminatory, or otherwise unlawful, including content that violates third-party intellectual property rights or promotes hate speech, child exploitation, or abuse.
- Spamming: Transmitting or procuring the sending of unsolicited or unauthorized advertising, promotional materials, junk mail, chain letters, or other spam, in violation of the GFunnel Anti-Spam Policy (https://www.gfunnel.com/antispam).
- Security Violations: Using automated systems (e.g., robots, spiders, offline readers) to send excessive requests to GFunnel servers; attempting to gain unauthorized access to the Services or related systems; introducing malicious code; or engaging in denial-of-service or distributed denial-of-service attacks.
- Unauthorized Sharing: Sharing access credentials, screenshots, code, or other content from password-protected areas of the Services with unauthorized persons or entities not bound by GFunnel’s Terms, Privacy Policy, or this AUP.
- Sensitive Data Misuse: Storing or processing sensitive information (e.g., credit card data, Social Security numbers, HIPAA-protected health information) in unauthorized areas of the Services, unless explicitly permitted with a signed Business Associate Agreement (BAA) for HIPAA data.
- Competitive Use: Using the Services for competitive analysis, developing competing products, or any purpose detrimental to GFunnel’s commercial interests.
- Excessive Use: Overburdening or impairing GFunnel’s servers or infrastructure, including excessive data usage that negatively impacts platform performance.
- Misrepresentation: Impersonating GFunnel, its employees, or other users, or misrepresenting your affiliation with GFunnel.
- Third-Party Violations: Using the Services to violate the terms of third-party providers (e.g., Google, Facebook, MyDukaan) integrated with GFunnel Platforms.
4. Client Responsibilities
As a Client, you are responsible for ensuring that your employees, staff, partners, and other authorized Users comply with this AUP. Your responsibilities include:
- Training and Monitoring: Training Users on proper and secure use of the Services, including the Branded Flows AI software, and monitoring their compliance to prevent misuse, especially when serving third parties.
- Credential Security: Ensuring that Users maintain the confidentiality of access credentials and report unauthorized use immediately to support@gfunnel.com.
- Legal Compliance: Ensuring that Users comply with all applicable laws when using the Services to serve third parties, including obtaining necessary consents for data processing (e.g., GDPR, TCPA) and maintaining accurate records.
- Content Review: Reviewing and approving all content posted or transmitted via the Services (e.g., websites, emails, SMS) to ensure compliance with this AUP and applicable laws.
- Liability: You are liable for any violations of this AUP by your Users, including any damages, losses, or expenses incurred by GFunnel as a result.
5. Enforcement
GFunnel reserves the right to monitor usage of the Services to ensure compliance with this AUP. If GFunnel determines, in its sole discretion, that you or your Users have violated this AUP, GFunnel may:
- Suspend or terminate access to the Services for you or specific Users without notice.
- Remove or disable access to any content or materials that violate this AUP.
- Report violations to appropriate authorities, including law enforcement or regulatory bodies.
- Pursue any other remedies available under the Terms of Service, including termination of the Agreement or collection of damages.
GFunnel has no obligation to prescreen, monitor, or edit content but may do so to enforce this AUP. You agree to cooperate with GFunnel in investigating or resolving any suspected violations.
6. Reporting Violations
If you become aware of any violation of this AUP by you, your Users, or third parties, you must promptly notify GFunnel at support@gfunnel.com. Provide details of the violation, including the nature, date, and affected Services, to facilitate investigation.
7. Third-Party Services
The Services may integrate with third-party providers (e.g., Lead Connector, MyDukaan, Yext). You and your Users must comply with the terms of service, acceptable use policies, and other requirements of these providers when using integrated services. GFunnel is not liable for violations of third-party terms or disruptions in third-party services.
8. Updates to this AUP
GFunnel may update this AUP at its discretion to reflect changes in Services, laws, or business needs. Updates will be posted at https://www.gfunnel.com/acceptable-use-policy, with the "Last Updated" date revised. You will be notified of material changes via email or GFunnel platform notification. Continued use of the Services after updates constitutes acceptance of the revised AUP. If you do not agree with changes, you must notify GFunnel in writing within 30 days at support@gfunnel.com, and your subscription will continue under the prior AUP until the end of your current Term.
